Ongoing service agreement asic

ASIC is proposing to issue guidance on how it will regulate ongoing fee arrangements ( OFAs ). Depending on the position it takes, these arrangements , which have been challenging for the advice industry to comply with since they were introduced as part of the Future of Financial Advice reforms, could be simplified or may become even more onerous. Advisers that enter into ongoing service agreements with retail clients must give a fee disclosure statement each year and a renewal notice every two years unless an ASIC approved code of practice applies to the adviser. The client can opt-out at any time and if the client does not opt-in the adviser cannot continue to charge any ongoing fees.


ONGOING SERVICE FEE AGREEMENT. This document sets out the basis of our fees following the engagement of the company as your agent in respect of providing you with ongoing services and to act as your agent in dealing with Product Providers and Institutions in relation to your existing contracts and policies.

Commissioner Kenneth Hayne took exemption to ongoing service agreements in his royal commission final report, saying the two-year contracts give advisers a “financial advantage” over their clients and were partly to blame for the fee-for-no-service scandals.
