Your notice period starts the day after you resign. This means if you give a week’s notice on Monday your last day at work will be the next Monday. If you haven’t discussed a notice period and you don’t have anything in writing, you should give at least week’s notice. The reason for this is that most casual staff have the employment status of ‘worker’. And they don’t have the same rights as ‘ employees ’. Workers can’t request flexible working, get protection against an unfair dismissal or work a minimum notice period.
But not all zero hours staff are workers. Can an employer terminate your probationary period? Do you need notice period? When is notice required by employer? When an employee resigns , they may have to give written notice via a letter to their employer.
Therefore, a casual employee employed on a regular and systematic basis is still a type of casual employee. Consequently, the terms (if any) of the applicable modern award or enterprise agreement will determine whether a casual employee is entitled to receive a period of notice of termination. For casual employees , no notice period is required. This applies to both the employer and employee. This means that you can resign from a job without having to work any additional time afterwards.
Conversely, an employer can terminate you without any notice or payment in lieu of notice.
