Seaway bill of lading

Bills of Lading and Sea Waybills are the two main documents used in the transport of goods by sea , both domestic and abroad. A bill of lading functions as a contract of carriage, receipt of goods by carrier and document of title. Means, the seaway bill can not be used for negotiation procedures with bank.


Seaway bill is not a document of title. The bill of lading is issued by a carrier or their agent. Subject to nemo dat rule, a bill of lading also serves as document of title to the goods.

A Sea Waybill is not negotiable and cannot be assigned to a third party. It is also NOT a Document of Title. Sea waybill is a non-negotiable bill of lading , invented by the transportation industry very recently, to respond the market, that demands a more flexible marine transport document than a conventional bill of lading. You can use this bill when seller and buyer have a strong business relationship. It’s still very important to focus on the repute of the seller in the market.

Kindly bear in mind tht by its very nature a bill of lading is a document of title, a seaway bill is not (also a straight bill of lading may be negotiated by means of a letter of assignment). So there is no requirement to present a seaway bill (if issued) to the carier as the carrier is supposed and under obligation to deliver the cargo to the consignee as mentioned in the seaway bill.
